These Terms and Conditions set out the basis on which HOLA HOSTEL (as defined below) will provide accommodation and other products and services at its hostels to Clients (as defined below) and Guests (as defined below). By making a Booking (as defined below), the Client agrees to comply with these Conditions.
1. INTERPRETATION
In these Terms and Conditions, unless the context requires otherwise, the following expressions shall have the following meanings:
- “Arrival date”: refers to the date on which the Client’s stay at the hostel must begin, according to the booking details.
- “Reservation”: means the reservation by the Customer of accommodation and any other product and service detailed in the Reservation that is accepted by HOLA HOSTEL.
- “Booking Details” refers to the details of the Booking, including the number of Guests, the number of rooms required, the length of the Guests' stay at the Hostel and any other product and/or service included in the Booking.
- “Charges”: means the amounts payable by the Customer in connection with the Booking.
- “Contract” means the contract between the Client and HOLA HOSTEL in relation to the Booking.
- “Client”: means the person who makes the Reservation.
- “HOLA HOSTEL”: means HOLA HOSTALES SL (company registered in Barcelona with the number ESB66039991) or any other company of the same group of companies as HOLA HOSTEL that operates the Hostel.
- “Guests” means the Client and any third party invited to the Hostel in connection with the Booking.
- “Hostel”: means the hostel owned or operated by HOLA HOSTEL, the location of which is specified in the Booking.
2. RESERVATIONS
2.1 Customers can request Reservations through the HOLA HOSTEL website or by contacting HOLA HOSTEL staff at the Hostel.
2.2 When requesting Reservations, Customers must provide identification information which includes, among other details, their name, address, contact telephone number and email address.
2.3 No Booking request will be considered accepted until HOLA HOSTEL confirms its acceptance and provides a booking reference, at which time the Contract will come into effect.
2.4 Subject to clause 4, HOLA HOSTEL will make all reasonable efforts to accommodate any request from the Client to change the Booking Details, but any request to change the dates or length of stay, or to add products and/or services, will be subject to availability and payment by the Client of the corresponding amount for such increase in stay and/or products and/or services, in accordance with HOLA HOSTEL's current standard rates.
2.5 When booking beds in a shared room, HOLA HOSTEL will try to place the people included in the same booking in the same room; however, this cannot be guaranteed.
3. FEES AND PAYMENT
3.1 The charges will be those quoted by HOLA HOSTEL to the Client when he requests a Reservation.
3.2 Unless otherwise agreed by HOLA HOSTEL, the Charges only cover the provision of accommodation at the Hostel and the Client may incur additional charges including, but not limited to, charges for meals, room service and wireless Internet access (the “Additional Charges”).
3.3 Customers will be informed of the amount of Additional Charges before they are incurred.
3.4 Reservations will be subject to the Client making full payment of the Charges in advance or, at HOLA HOSTEL's option, paying a booking fee and/or deposit, normally 10% of the total, and providing valid credit or debit card details through which payment of the Charges or the outstanding balance of the Charges, as applicable, as well as any Additional Charges, can be made upon check-in at the hostel or at the time of the Reservation.
3.5 If the full amount is not paid in advance at the time of booking, the remaining balance of the charges must be paid by the client immediately upon check-in at the hostel. Any additional charges must be paid when incurred or, at HOLA HOSTEL's option, at the time of the client's check-out from the hostel.
3.6 The following payment methods are accepted by HOLA HOSTEL:
3.6.1 Cash or credit or debit cards, if the Customer pays personally at the Hostel.
4. CANCELLATIONS
4.1 Subject to clause 4.2, the Client may cancel the Reservation free of charge if they notify HOLA HOSTEL at least 72 hours before 2:00 PM (local time) on the Arrival Date. In that case, HOLA HOSTEL will refund the Client all amounts paid in advance.
4.2 When the Customer has been offered a discounted rate on the condition that the Booking is non-refundable after cancellation, provided that the Customer has been informed of this condition, in the event of cancellation of the Booking, all Charges applicable to that Booking will still be payable in full.
4.3 If the Client does not notify the cancellation in sufficient advance as per clause 4.1 or does not show up at the Hostel, the Reservation will be considered cancelled and the Client must pay the Hostel an amount equivalent to the Charges applicable to the total amount of the stay at the Hostel.
4.4 HOLA HOSTEL may cancel a Booking at any time if the Hostel is unavailable due to circumstances beyond HOLA HOSTEL's control, in which case HOLA HOSTEL will refund the Customer the full amount of the Charges and any Booking fees paid.
4.5 HOLA HOSTEL may cancel the Reservation at any time if the payment details provided by the Customer in accordance with clause 3.4 are not valid and the Customer does not provide valid alternative details.
5. ENTRANCE AND EXIT
5.1 Check-in time at the booked hostel is from 2:00 PM. Early check-in may be available, subject to prior arrangement with HOLA HOSTEL, as all hostel services and facilities may not be available until the standard check-in time.
5.2 Check-out time at the booked hostel is 11:00 AM. Late check-outs may be possible by prior arrangement, at an additional charge and subject to availability. In the absence of such prior arrangement, if check-out is not completed by 11:00 AM, the Client may be charged for an additional night's accommodation at the applicable standard rate.
5.3 Luggage storage is provided for an additional charge until 23:59 on the same day of departure and can be arranged at reception.
6. HOSTEL RULES
6.1 A valid photo ID, in the form of a driver's license or passport, is required at check-in.
6.2 Clients are required to behave, and ensure that their Guests behave, in a reasonable and responsible manner at the Hostel, and must not act in any way that may disturb other guests. Failure to comply with this requirement may result in Guests being asked to leave the Hostel, in which case all Charges and Additional Charges will be payable immediately by the Guest.
6.3 Smoking is not allowed inside the Hostel and can only be done in designated smoking areas.
6.4 The Client will be responsible for any loss or damage caused to the Hostel by Guests or Guest visitors. The Guest may be liable for HOLA HOSTEL's reasonable cost to repair, clean, or replace any HOLA HOSTEL property that has been damaged, soiled, or lost by a Guest.
6.5 No animals are allowed in the shelter, except for guide dogs.
6.6 HOLA HOSTEL does not accept reservations made by guests under 16 years of age. Guests under 18 years of age cannot stay in shared rooms; however, they can stay in private rooms if accompanied by an adult over 18 years of age. If you are between 16 and 18 years old and wish to stay in a private room, you will need written consent from your parents or guardians. Failure to comply with this rule will result in automatic cancellation without refund.
6.7 We do not accept bookings for stag or hen parties at any of our hostels. HOLA HOSTEL reserves the right to refuse entry to anyone who has booked online and is part of such a group.
6.8 Upon check-in, you will be given a key card that will grant access to both the hostel and your room. If you lose your access card, the replacement cost will be €3 (Barcelona).
6.9 Each hostel may have its own rules, described at the establishment itself, at reception, which in no way replace those described in this document, but are additional. Upon check-in, these rules are fully accepted.
7. FOOD AND DRINK
7.1 Unless otherwise agreed by HOLA HOSTEL, charges do not include food or drink.
7.2 Customers and their guests may not consume alcoholic beverages purchased outside the Hostel.
8. PEOPLE WITH DISABILITIES
8.1 HOLA HOSTEL complies with all laws regulating the treatment and provision of accommodation to guests with disabilities.
8.2 Customers with special requirements related to a disability must inform the hostel management team before the Arrival Date.
9. HOLA HOSTEL'S RESPONSIBILITY
9.1 Nothing in these Terms is intended to limit or exclude HOLA HOSTEL's liability for:
- (a) death or personal injury caused by the negligence of HOLA HOSTEL, its employees, subcontractors or agents;
- (b) fraud or fraudulent misrepresentation; or
- (c) any other matter for which it would be illegal for the Hostel to limit or exclude its liability.
9.2 If HOLA HOSTEL breaches these Terms and Conditions or acts negligently, it will be liable for any loss or damage suffered by the Client that is a foreseeable consequence of such breach or negligence, but will not be liable for any loss or damage that is not foreseeable. Loss or damage will be foreseeable if it is an obvious consequence of HOLA HOSTEL's breach of these Terms and Conditions or if it was contemplated by HOLA HOSTEL and the Client at the time the Contract was entered into.
9.3 The Client accepts that HOLA HOSTEL only provides its facilities, products and services to the Client for private use and has no liability to the Client for any loss of profits, loss of business, business interruption or loss of business opportunities.
10. PERSONAL DATA
10.1 The processing of Customer data by HOLA HOSTEL is governed by the Personal Data Protection Act (15/1999, of December 13).
10.2 The Client consents to HOLA HOSTEL collecting the Client's personal data, such as name, surname, email address, social security number, customer number, address, contact information, bank account number details and IP number.
10.3 Personal data is used by HOLA HOSTEL for the performance of the Contract, for marketing, as a basis for statistics, and for the development of HOLA HOSTEL products. HOLA HOSTEL has the right to share your personal data with its partners for advertising and promotional purposes.
10.4 Personal data may be analyzed and grouped for the selection, prioritization and marketing planning of HOLA HOSTEL, called profiling.
10.5 As a HOLA HOSTEL customer, you agree to receive marketing information by mail, telephone, email, text message, and other digital channels. Marketing via email and SMS is regulated by Swedish Marketing Law. Your personal data may be shared with all offices of the HOLA HOSTEL group.
10.6 Personal information is disclosed to Spanish authorities only when required by law or an official order.
11. GENERAL INFORMATION
11.1 The Customer's rights as a consumer under the consumer protection legislation in force at any given time shall not be affected by these Conditions.
11.2 HOLA HOSTEL may transfer its rights and obligations under the Contract to another organization, but will always inform the Customer if this happens, and this will not affect the Customer's rights under the Contract.
11.3 HOLA HOSTEL shall not be liable to the Client for any failure or delay in the performance of its obligations when such failure or delay is due to an event beyond HOLA HOSTEL's control (including, but not limited to, extreme adverse weather, industrial action, or natural disaster). If such an event prevents HOLA HOSTEL from fulfilling the Reservation, either party may cancel the Contract.
11.4 HOLA HOSTEL may change these Terms and Conditions at any time without prior notice. However, the version of these Terms and Conditions in force at the time of booking will continue to apply to the agreement. Customers are advised to consult the HOLA HOSTEL website for the latest version of these Terms and Conditions before making a booking.
11.5 HOLA HOSTEL complies with the obligations imposed on it by Organic Law 15/1999, of December 13, on the Protection of Personal Data (the “Law”). HOLA HOSTEL will process the personal data (as defined in the Law) of Clients and Guests solely for the purpose of fulfilling its obligations and exercising its rights in relation to the Contract. HOLA HOSTEL will not provide such personal data to third parties, except to third parties that provide services to HOLA HOSTEL, such as the provision of legal advice.
11.6 Failure by HOLA HOSTEL to enforce any provision of these Terms shall not constitute a waiver of its right to subsequently enforce such provision or any other provision of these Terms. Such failure shall not be deemed a waiver of any prior or subsequent breach and shall not constitute a continuing waiver.
11.7 If any provision of these Terms is deemed invalid or unenforceable by a competent authority, in whole or in part, the validity of the other provisions of these Terms and the remainder of the provision in question will not be affected.
11.8 This Contract, including non-contractual matters and obligations arising out of or associated with it, shall be governed by and construed in accordance with the laws of Spain, and the courts of Barcelona shall have jurisdiction to hear any dispute arising out of or relating to it, including non-contractual matters.
11.9 No person who is not a party to the Contract shall have any rights in relation to it.
FORBIDDEN
- Smoking is not allowed anywhere inside the hostel.
- Selling and consuming alcoholic beverages is prohibited.
- People who are not staying at the hostel will not be allowed to enter the rooms or use any equipment or facilities.
- Changing the bed or wardrobe without staff permission is prohibited.
- Maximum stay: 15 days.
Guests are expected to respect other guests, staff, local residents and the property.
HOLA HOSTEL EIXAMPLE reserves the right of admission and/or continued stay in case of failure to respect any of the rules.
Guests who do not respect the hostel rules or standards of coexistence with other guests or staff may be expelled without any refund.
